1.1 Parts of the Website (as defined below) and these regulations may contain terms in the masculine, but this is for convenience only and everything stated in the regulations and on the Website applies equally to both women and men.
1.2 The website thesetaihotels.com (hereinafter, the “Website”) is under the sole ownership of the Setai Hotels chain (hereinafter, the “Company”). The website provides as much information as possible about the Company’s hotels, the services provided by the hotels, prices, promotions, etc. On the Website you can purchase online vacations and/or vacation packages in the Company’s hotels, as detailed on the Website and according to the sales terms and conditions that appear.
1.3 Vacations/vacation packages (hereinafter, the “Services”) can be booked through the Website as detailed below. It is clarified that booking the services is a binding procedure for all intents and purposes and is the same as booking rooms by any other means, through the Company’s Internet/reservations department.
1.4 Guests warrant to maintain the functionality and integrity of the equipment in the hotel, including the equipment in the rooms, the facilities on the hotel grounds and bicycles borrowed by a guest, for which the guest is fully responsible, including for checking them before accepting them.
1.5 In the event of damage and/or loss of the equipment listed above, the guest will be charged the value of the damage without a need for proof.
1.6 It is clarified that until an order confirmation is received from the Company, the order will not bind the Company.
1.7 It is clarified that for orders placed through the Company’s Website, they will be considered a distance sales transaction only when they meet all the conditions set forth in the Consumer Protection Law, 5741-1981.
1.8 The Website is intended for orders by private customers, in an individual setting and is not intended for group orders. The Company may not approve an order request for any reason, at its sole discretion and without the need for explanations and the user will not have any grievance and/or claim and/or demand against the Company in this matter.
1.9 The price lists are shown without the addition of VAT for those ordering from outside Israel / with a foreign IP address. Residents of Israel and holders of an Israeli passport who order from these price lists will be charged an additional VAT payment at the time of their arrival at the hotel, as required by law. If a VAT amount of ILS 0.00 appears in the order confirmation, this indicates that the order was made from a non-Israeli Internet (IP) address, and the guest will be charged additional VAT at check-in.
1.10 – For the purpose of the order- “infant/baby”- is anyone under the age of 2. A “child”- is anyone between the ages of 2-12.
1.11 Check-in : starts at 4:00 p.m. Check-in on Saturday/Jewish Holidays starts one hour after Shabat/Holiday Ends.
Check-Out: Ends at 11:00 a.m. Check-out on Saturday/Jewish Holidays Ends at 02:00 p.m.
2.1 Every user of the Website and/or everyone who purchases services through the Website and/or who is interested in purchasing services through the Website (hereinafter, a “User”), represents and warrants that he is aware of these regulations, has read them, understood their contents and agrees to their provisions, and that neither he nor anyone acting on his behalf will have any claim and/or grievance and/or demand, whether directly and/or indirectly, against the Company and/or the Website and/or any of its operators/or any of its owners and/or any of its managers and/or any of its employees and/or anyone acting on their behalf. 2.2 The User may use this Website only for the purpose of ordering and purchasing services and/or receiving information. For the avoidance of doubt, it is hereby clarified that it is prohibited to make any use of the site’s content, including the images that appear on the site, the site’s content or any other information that appears on the site. Use of any of these contents may only be made after receiving written approval from the management of the chain, except as specified in these regulations and the Company reserves all its rights in this matter. It is clarified that illegal use of this Website and/or the information appearing on it violates copyright and/or other laws related to it.
2.3 Any person who personally and lawfully holds a valid credit card from the following credit companies: Visa C.A.L., Diners Club, American Express, Isracard and MasterCard, may purchase services through the Website. Payment for these orders is at the hotel only, and the credit card details provided on the Website is solely for security purposes and on condition that the buyer provided all the credit card details according to the law.
2.4 The Company will not be responsible for the content and substance of the information displayed and published on the Website and on behalf of the Company, where this is information originating from any third parties. The User will not have any claim and/or grievance and/or demand against the Company in this matter.
2.5 All the images displayed on this Website are for illustrative purposes only, as when the images are displayed on the User’s computer monitor and/or when printed there may be differences and changes between the appearance of the products in the image and their appearance in reality.
2.6 On the Website thesetaihotels.com you can find links (hereinafter, “Links”) to other Websites (hereinafter, “Linked Sites”). These Links are intended for the convenience of the User and for this purpose only. The Company is not responsible for the Links and/or the Linked Sites and/or the information appearing in them, their validity, correctness and legality. Any use and/or access of Links and/or Linked Sites is at the sole responsibility of the User. In order to link and/or display the Website on other sites, you must contact the Company to obtain written permission
2.8 The Company and/or the operators of the Website and/or its owners and/or its managers and/or its employees and/or any of them or anyone acting on their behalf, will not bear any responsibility for the web server on which the Website operates, including that said web server will be free of viruses and/or other components that may damage the User’s personal computer when browsing the Website and/or purchasing services through the Website and/or any other use of the Website, and the User shall not have any claim and/or grievance and/or demand against the Company and/or any of the Website operators and/or any of its owners and/or any of its managers and/or any of its employees and/or anyone on their behalf in connection with such damage. The Company, nevertheless, does everything in its power to prevent such occurrences.
2.9 The Company is not responsible for damage of any kind and type that may be caused as a result of failure and/or delay of any kind or type, which may be caused as a result of using the Website and/or attempting to use it, including use for the purposes of ordering services and/or obtaining information and the User shall not have any claim and/ or grievance and/or demand against the Company in connection with this.
2.10 The Company is not responsible for any illegal activity that may be performed, if any is performed by any of the Website users and/or any other party over which it has no control.
2.11 The Company has the right to prevent or terminate the access of any User to any part of the Website and the User shall not have any claim and/or grievance and/or demand against the Company in this matter
2.12 Any conflict and/or dispute in connection with these regulations and/or the Website, if and when one arises, will be resolved in Israel, according to the laws of the State of Israel only and in the competent courts in the city of Tel Aviv-Yafo, only.
3. Details of the purchaser of the services
3.1 A User wishing to purchase services through the Website will be required to enter details as required on the Website and by law (hereinafter, the “Purchase Details”).
3.2 The Company is not responsible, whether directly or indirectly, for cases where the Purchase Details were not recorded in the system and/or for any technical and/or other problem that prevents the User from purchasing services through the Website.
3.3 The owners of the Website and/or any of its operators and/or any of its owners and/or any of its managers and/or any of its employees and/or anyone on their behalf shall not be responsible for any mistake made by the User when entering the Purchase Details, including but not limited to, a mistake in choosing the vacation package, date, number of vacationers, meals, and also any other service ordered by the User through the Website, and the User hereby represents that he will not have any claim and/or grievance and/or demand in this regard.
3.4 It is hereby clarified that submitting false Purchase Details is a criminal offense and that the Company will be entitled to take all measures available to it according to any law against those submitting false details, including tortuous claims for damages that may be caused to the Website, its operators and/or anyone on their behalf.
4. The Best Price Policy
This policy applies to the booking of vacations at Setai Hotels.
The guarantee is given with regard to the prices on the websites of competing parties.
We give you the best price – with a guarantee that if you booked a vacation on the Stay Website and, after booking, you found a better price on a competitor’s Website, where:
The vacation details are identical
- Same hotel;
- Same vacation dates;
- Same basis of accommodation and same number of guests
Then we will match the price within 24 hours of placing the order.
In order to benefit from the best price policy, you are to send us the following details:
- A screenshot of the price quote as it appears on the competitor’s website (a full screenshot that includes the website address, and the date and time on the computer);
- A link to the price offer on the competitor’s Website;
- The vacation booking confirmation number on the Stay Website;
- Contact details.

- Cancellation Policy
5.1 Cancellation by the User:
Last minute cancellation fees: 100% of the entire order value.
Up to 3 days before the arrival date – no charge.
From 3 days until the arrival date – a charge of 25% of the order value.
Peak season – July, August and Jewish holidays
Up to 7 days before the arrival date – no charge.
From 7 days until the arrival date – a charge of 50% of the order value.

For any change in an order (dates, destination, etc.) that is done at the User’s initiative, the User may be required to pay additional change fees to the Company in accordance with its procedures.
A cancellation and/or change made on Saturday and/or any other day of rest in Israel will be considered (for the purpose of determining cancellation fees) as if made on the following business day.
5.2 Cancellation by the Company
The Company reserves the right to stop at any time, at its sole discretion, the sale on the Website, in whole or in part, including in any of the cases listed below:
(a) If it turns out that an illegal activity has been or is being performed on the Website.
(b) If the User provided false and/or incorrect information during his registration. It is hereby clarified that entering false Purchase Details is a criminal offense and that the Company and/or the Website operator will be entitled to take all the measures available to them according to any law against the submitter of the false registration; including applying to the courts for damages that were caused or that may be caused to the Website, the Company and/or the operator of the Website and/or anyone on their behalf.
(c) If the credit card in the User’s possession has been blocked or otherwise restricted for use.
(d) If there was a communication malfunction and/or a technical malfunction that prevented or could have prevented a particular purchase.
(e) In a case of force majeure, acts of war, hostility or terrorism which, in the opinion of the Company, prevent the continuation of the sale, its performance, sufficient participation in it or the realisation of the order.
(f) If there is an error in the description of the services, the terms of the services, the terms of the order, and/or in the event of an error in the entry of the sales data and/or in the entry of the User data, the Company may cancel the specific purchase.
(g) In any case that an action was taken contrary to these regulations, notice of such cancellation or termination will be given to the User and/or the customer, and the Company will refrain from charging the customer’s credit card and will refund any amount paid for the vacation that was purchased, if payment has been made.
The Company reserves the right, at its sole discretion, to change and/or cancel any order (or part of it) for any reason whatsoever, including if the number of guests does not justify the provision of the room and/or service purchased by the customer and/or User. The Company also has the right to cancel and/or replace any room and/or service purchased by the customer as part of the offered services, in another room and/or service, all subject to the law.
The Company has the right to cancel or change the terms of acceptance of orders as well as all prices and the services published on the Website at any time. The Company will have the right not to approve and/or to unilaterally cancel any transaction recorded in the system, even if an automatic confirmation message in connection with it is received by the customer.
The Company may change from time to time the structure of the Website, its content, its appearance, the conditions of its use, the scope and availability of the services offered on it, and any other aspect involved in the Website and its operation, all without the need to notify the customer in advance.
Discount codes (hereinafter, “Coupons”) can be used for prepaid hotel reservations, except for reservations at non-participating hotels, the list of which will be published with each specific Coupon.
The list of participating hotels can change at any time.
Coupons with a discount in a certain currency cannot be used for orders for which payment is made in a different currency.
If the discount is based on a percentage (for example, a 10% discount), in the case of booking multiple rooms (when booking two or more rooms in the same booking) the discount will only apply to the price of the first room included in the booking request.
For specific restrictions on the use of Coupons, see the relevant notices about them.
Only one Coupon can be used per order. Standard terms and conditions apply to the booking and all bookings are subject to availability. Coupons cannot be sold or transferred.
All taxes, fees, charges and surcharges apply to orders made using Coupons. These charges must be paid upon booking or directly at the hotel, and payment of these charges is your responsibility. Coupons have value only when redeemed in accordance with the terms and conditions of the offer. Coupons cannot be refunded in cash or equivalent. Single-use Coupons will be considered fully used once a qualifying order has been placed, and will not be returned or exchanged and will not be refunded if they have only been partially redeemed. Multiple use Coupons will be considered fully used subject to the restrictions set forth in the specific Coupon’s terms and conditions.
If the dates of your stay at the hotel change after you have used the Coupon, the Coupon will not apply to the new dates of your stay. Coupons may not be used for previously purchased orders.
- Prohibition of illegal or unauthorised use:
As a condition of your use of this Website, you warrant that you will not use this Website for any purpose that is illegal or not authorised by these terms, conditions and notices.
The price of the rooms in the hotels of the chain will be as stated on the Website from time to time, except in cases of obvious error. Prices may change at any time, but these changes will not affect orders that have already been accepted. Despite the Company’s best efforts, some of the hotel rooms listed on the Website may be incorrectly priced. The Company expressly reserves the right to correct any pricing errors on our Website or in pending orders placed under an incorrect price. In such a case, if there is availability, we will offer you the option to keep your pending order at the correct price, or we will cancel the order without a cancellation penalty. The Company is not obliged to provide you with rooms at an incorrect (lower) price, even after you have been sent a confirmation of the reservation.
The Company reserves the right at its sole discretion to change or terminate the price guarantee, or limit the availability of the guarantee, to any person, at any time, for any reason or for no reason, and without prior notice or assuming any liability to you. The conditions in effect at the time of placing the order determine your eligibility under the price guarantee. Failure to enforce any section of these terms and conditions does not constitute a waiver of that section. Additionally, the company reserves the right to update the prices published on the website at any time, and this will be subject to its exclusive discretion.
- Force majeure:
The Company will be exempt from responsibility towards Users for a cancellation and/or change of their order, in any period of time, that is caused directly and/or indirectly due to force majeure. In this matter “force majeure” means any event that is outside the reasonable control of the Company and which affects or has potential to affect the ability of the Company and/or anyone acting on its behalf to fulfil their obligations to you, including but not limited to strikes, lockouts, riots, fire, flooding, weather, civil unrest, war, military operation, invasion, rebellion, epidemics, disease, boycotts, arrests, technical malfunctions and/or any action beyond the Company’s reasonable control whether this event was expected and/or unexpected. The Company reserves the right, at its sole discretion, to change and/or cancel any booking (or part thereof) if the number of guests does not justify the provision of the room and/or service that was purchased by the guests and/or for any other reason, and the Company also has the right to cancel and/or replace any room and/or service purchased by the guests as part of the offered services, with another room and/or service, all subject to the law.
The User and/or anyone on his behalf shall not have any claim and/or demand against the Company in relation to the non-fulfilment of its obligation and/ or the performance of its obligation in a manner that differs from the original order (as far as possible), if these were caused by circumstances related to force majeure. The Company will not be obliged to return the User’s money in cases where it and/or anyone on its behalf do not fulfil their obligations in full or in part due to circumstances related to force majeure.
