Privacy Policy

The Setai Hotel Chain (hereinafter: “the Chain”) places great importance on protecting the privacy of its customers. This Privacy Policy was adopted by the following hotels of The Setai Hotel Chain: Zel Hotels Ltd., Hod Dead Sea Hotel Ltd., Faber Ltd., Achuzat Beit BaGalil Ltd., Megadalot Tel Aviv Limited Partnership, Papo Tourism Holdings Ltd., Orchid Hotel Ltd., Opera House Hotel Limited Partnership (hereinafter, each: “the Hotel” or “we”).

This Policy pertains to the collection and dissemination of information (hereinafter: “Privacy Policy”).

The Privacy Policy specifies the types of Personal Information and Other Information (as defined below) that the Hotel collects about: (1) Visitors and guests at its Hotels (including, but not limited to: guests, visitors, companions, club members, guests of the aforementioned, and anyone seeking to enter the Hotel premises and/or stay at the Hotel, use its facilities, or visit someone staying at the Hotel, as well as users or those requesting to use the services offered by the Hotel); (2) Users of the Websites (as defined below) and/or Apps (as defined below); (3) Individuals interacting with the Hotel in any manner, including by telephone; and (4) Visitors to the Hotel’s social media pages (hereinafter collectively: “the Users”). The Privacy Policy outlines how the Hotel collects Information, the purposes for which the Information is used, including storage, processing, and transfer to third parties, and more.

Where the terms “you” or “your” appear in this Privacy Policy, they refer to all Users of the Services (as defined below) and the Personal and Other Information (as defined below) related to said Users.

The Hotel collects Personal Information and Other Information (as defined below) through the following:

  • Websites operated by the Hotel, through which you access this Privacy Policy, whose address is https://thesetaihotels.com/ and/or additional websites owned or controlled by the Hotel (collectively referred to as “the Websites”);
  • Apps made available by the Hotel for use on computers or mobile devices (hereinafter: “the Apps”);
  • Social media pages owned and controlled by the Hotel (hereinafter collectively: “Social Media Pages”);
  • When you visit or stay as a guest at one of the Hotels listed above or through other offline interactions with the Hotel (for example, making calls to the call center and/or reservation center).

The Websites, Apps and Social Media Pages shall collectively be referred to as the “Online Services,” and, together with offline channels, as “the Services.”

By using the Services, you agree to the terms of this Privacy Policy. Please read the Privacy Policy carefully.

The Hotel acts as the Data Controller of your Personal Information.

The information you provide or will provide to the Hotel, whether orally or in writing, is subject to your consent and willingness and is not required by law.

However, if you do not provide the information or do not allow the Hotel to collect such information, the Hotel will not be able to provide you with the Services.

Collection of Personal Information and Other Information

  1. “Personal Information” refers to data that identifies you as individuals or pertains to a specific person. The Hotel collects Personal Information such as:
    • Contact details (name, email address, mailing address, phone number, fax number, passport number, ID number, photo, and/or identification document for identification purposes, as required);
    • Payment information (payment card: digits and expiration date in accordance with PCI DSS standards, billing address, and bank account number);
    • Demographic data (age, sex, residential address, citizenship, and preferred language);
    • Information about family members and companions, such as names and ages of children;
    • Information related to your reservation, stay, or visit to the Hotel (arrival and departure dates, goods and services purchased, personal preferences (as defined below), phone calls made);
    • Information required to fulfill special requests and/or special accommodation conditions (preferences, leisure activities, companion’s name, number and ages of children);
    • Guest preferences (“Personal Preferences”), such as interests, activities, hobbies, food and beverage choices, services, and requests you have notified the Hotel about or preferences learned about you during your visit;
    • Information related to members of the customer club program;
    • Information based on geographical or other location data;
    • Photos collected, if any, during the user creation process or updated later by the user (uploading a photo is optional and not used);
    • Photos, videos, and audio collected using security cameras located in public areas of the Hotel, such as corridors, lobbies, and parking lots (through CCTV systems and electronic key cards).
  2. “Other Information” refers to data that does not reveal your specific personal identity or pertain to a specific individual. The Hotel collects Other Information such as browser and mobile device data, including IP address, data collected through cookies, pixel tags and other technologies, aggregated data regarding guest stays at the Hotel, and responses to promotional offers and surveys.
  3. In certain cases, the Hotel combines Personal Information with Other Information (for example, combining a guest’s name and location). In such cases, the combined information will be treated as Personal Information as long as it remains combined.
  4. If you provide the Hotel and/or its service providers with information that includes Personal Information about third parties (for example, when making a reservation for another person, booking a room for additional guests, or receiving/inviting companions/visitors to stay with you at the Hotel), you declare that you have obtained the third party’s consent to provide such information, that you are authorized to do so, and that the third party permits the Hotel to use the information in accordance with the provisions of this Privacy Policy.

How Personal Information and Other Information Are Collected

Personal Information and Other Information are collected as follows:

  1. Online Services: When making a reservation, purchasing goods or services, contacting the Hotel and its representatives in any manner, posting on social media pages, subscribing to mailing lists, participating in surveys, feedback, contests or marketing offers, and when applying for a job at the Hotel.
  2. Visits and Offline Interactions: During a visit to the Hotel, while staying as a guest or accompanying a guest, and when using the services offered by the Hotel. Additionally, Personal Information is collected when participating in marketing events or promotional activities as a guest of the Hotel, or at promotional events hosted by the Hotel, or when providing Personal Information as part of a sales event promotion. Personal Information is also collected via CCTV systems installed for security purposes in public areas, through electronic key cards and other security systems.
  3. Other Sources: Personal Information is also received from third parties, including travel agents, customer club programs, credit card companies, government authorities (to comply with legal requirements), survey companies and various service providers of the Hotel.
  4. Automatic Information: When you use the Websites and/or Apps as defined above, the Hotel receives and stores information related to activity on the Websites and Apps, as well as additional automatically collected information from the browser and mobile device. For example, as is common with other websites, the Hotel receives certain information when your browser accesses the Website, including IP address, browser type, operating system, mobile network data, pages viewed and browsing times. This information is used by the Hotel for communication and service provision to customers.
  5. Aggregated Information: Information that does not personally identify you or any other user.
  6. Customer Service Centers: When you make a phone reservation, contact the Hotel by email, fax, online chat or through customer service. Such communication may be recorded for quality assurance and training purposes.
  7. Purposes of Collection and Use of Personal Information and Other Information

The Hotel uses Personal Information and Other Information for one or more of the following purposes:

  • Processing Reservations and Purchases: The Hotel processes information related to transactions you have entered into with the Hotel, including through the Websites (hereinafter: “Transaction Data”). Transaction Data is processed to complete reservations, provide products and services, tailor services to your preferences, obtain feedback about your stay at the Hotel, and maintain records of such transactions.
  • Guest Communication: To offer services based on your preferences, information is collected before and during your stay at one of the Hotels. The information may be used for customer club events, which we may hold from time to time, alone or with partners or by our partners.
  • Responding to Inquiries: The Hotel processes information related to user inquiries about the Services (hereinafter: “Inquiry Data”). Inquiry Data includes the content of the inquiry and related metadata (for example, groups, meetings, and events). Inquiry Data is processed for communication with you and for record-keeping.
  • Business Purposes: The Hotel processes information for business purposes, including developing new products, improving the Website, enhancing services, identifying usage trends and guest visit patterns, determining the effectiveness of promotional activities, evaluating third-party performance (for example, travel agents), forecasting revenue and occupancy, and meeting obligations.
  • Administrative and Other Communication: Sending information about the Website, changes to the terms of use, changes to the Privacy Policy or other administrative information (for example, information about reservations, such as email confirmations).
  • Marketing and Promotions: Sending marketing messages and promotional offers about the Hotel and related products and services that the Hotel believes may interest you, including spa services, fitness rooms, bars, restaurants and more.
  • Website Operation and Improvement: Operating, developing, improving, and managing the Hotel’s Website, as well as enhancing and tailoring the service to customers.
  • Safety and Security: Ensuring your health and safety, as well as that of other guests and the Hotel’s staff during your stay at the Hotel.
  • The Hotel’s Legal Obligations: Complying with legal requirements, including laws, regulations, guidelines, and legal proceedings.
  • The Hotel may use Personal Information and Other Information, in whole or in part, to perform certain statistical calculations, some of which may be displayed in the Apps, Websites, and/or other services, provided they do not include identifying information.
  1. Legal Basis for Processing Personal Information

The legal basis for processing Personal Information is one or more of the following:

  • Provision of Services.
  • Compliance with legal requirements, including laws, regulations, orders, guidelines, judgments, and other requirements.
  • Legitimate and business interests of the Hotel.

Disclosure and Transfer of Personal Information and Other Information

  1. The Hotel may disclose and transfer Personal Information and Other Information as detailed below:
    • To any of the Hotels listed in this Privacy Policy above and/or to any related company of the listed Hotels, to provide a better hospitality experience based on your personal preferences and experience gained from your use of the Services provided by the Hotel in previous visits.
    • To a representative or travel agent who provided the Hotel with Personal Information about guests (for example, travel agent, companion, employer, or spouse).
    • To various service providers of the Hotel, such as IT service providers, legal advisors, accountants, payment service providers and others.
    • To the Hotel’s business partners in marketing and advertising, to promote relevant advertisements to users of the Website and encourage users to return to the Website. These partners will not use Personal Information for any purpose other than direct marketing as described, and you will always have the right to object to such use.
    • The Hotel may transfer Personal Information and Other Information about you to third parties in the event of restructuring, merger, sale of assets or shares of any of the Hotels listed in this Privacy Policy, joint ventures, assignment of rights and/or obligations of any of the listed Hotels, transfer, or other disposition of the Hotel’s business and assets, in whole or in part (including liquidation and similar proceedings).
    • Transfer of information to insurance agencies and/or insurance companies with which the Hotel works to handle guest inquiries.
    • To the Hotel’s service providers, to, among other things, enable and/or improve the Website and the browsing experience, tailoring it to the user experience.
  2. The Hotel may disclose Personal Information and Other Information if it determines that such disclosure is necessary:
  • To comply with legal requirements;
  • To comply with court orders in legal proceedings;
  • To respond to requests from public or governmental authorities;
  • To enforce the terms of use;
  • To protect the Hotel’s business;
  • To protect the rights, privacy, safety, or property of the Hotel, its guests, users of the Services, and others;
  • To enable the Hotel to pursue remedies it is entitled to under law and/or agreement and to minimize its damages.

Cross-Border Data Transfer

  1. Generally, data processing is conducted within the borders of Israel. Data processing by third parties or cloud services may be conducted on servers worldwide, such as Microsoft Azure or Microsoft 365 servers, Amazon servers, and similar.
  2. However, some information may be stored in the cloud outside the borders of Israel or the European Union. The operator of such services has committed to complying with GDPR regulations. In such cases, the Hotel ensures that appropriate measures are taken to secure Personal Information at an adequate level of protection.

How You Can Access, Modify, or Restrict the Use of Your Personal Information

If your place of residence is in the European Union, the following provisions apply to you:

  1. Right to Information About Data Processing: We strive to provide concise, transparent, clear, simple, and easily accessible information about the terms of Personal Information processing.
  2. Right to Access, Correct, or Delete Personal Information: We allow you to receive confirmation from us regarding whether your Personal Information is being processed, as well as details about the terms of such processing, and to receive an electronic copy of the information.
  3. Right to Correct Personal Data.
  4. Right to Request Deletion of Personal Information, subject to legal provisions and provided the following conditions are met:
    • The Personal Information is no longer necessary for the purpose for which it was collected, stored, or processed;
    • You request to withdraw your consent on which the processing was based, and there is no other basis justifying the processing of the Personal Information;
    • You believe and can substantiate that the Personal Information was processed unlawfully;
    • The Personal Information must be deleted in accordance with the Hotel’s legal obligations;
    • Right to Restrict Processing of Personal Information: This right applies in certain cases, particularly:
      • In case of a dispute regarding the accuracy of the Personal Information;
      • If you believe and can substantiate that the processing of Personal Information is unlawful but object to its deletion and instead request restriction of processing;
      • When the Hotel no longer needs the Personal Information, but you require it to establish, exercise, or defend your legal rights;
      • When a decision is made that the Hotel’s legitimate interest overrides your interests as the data subject.
  1. Right to Data Portability

If the basis for processing Personal Information is consent or a contract, you are entitled to receive the Personal Information you provided to the Hotel in a commonly used format and transfer it to another data controller.

  1. Right to Withdraw Consent

When the basis for processing Personal Information is consent, you may withdraw your consent at any time using the means provided (as detailed in this Privacy Policy below). Note that withdrawal of consent applies only to future processing and does not affect information processed prior to the withdrawal. For the avoidance of doubt, withdrawing consent does not affect the lawfulness of Personal Information processing conducted before the withdrawal.

  1. Right to Decide the Fate of Personal Information After Death

You may decide the fate of your Personal Information after death by providing general or specific instructions. The Hotel is obligated to respect these instructions. In the absence of instructions, the Hotel recognizes that heirs may exercise certain rights, particularly the right to access Personal Information if required for the deceased’s estate, the right to object to the closure of the deceased’s user accounts, and the right to object to the processing of the deceased’s information.

  1. Right to File a Complaint with the Relevant Data Protection Authority
    • If, despite the Hotel’s efforts to maintain confidentiality and privacy of Personal Information, you feel your rights have been violated, you have the right to file a complaint with the relevant data protection authority. A list of authorities is available on the European Commission’s website.
    • If your place of residence is outside the European Union (including Israel), you have the right to review and correct the information stored in the Hotel’s databases in accordance with Israeli law, including the provisions of the Protection of Privacy Law, 5741-1981.

  3. The Hotel takes reasonable organizational and technical measures to protect Personal Information from unauthorized access, disclosure, deletion, alteration, accidental loss, misuse, or damage. The Hotel conducts regular reviews and monitoring of these protective and security measures.
  4. When required to disclose or transfer Personal Information to third parties or authorized entities, the Hotel ensures that these third parties commit to an adequate level of data protection. The Hotel requires contractual commitments from third parties that Personal Information will be processed solely for the purposes you have consented to and in accordance with the required level of confidentiality
  5. If you have reason to believe that your communication with the Hotel is not secure, please contact us immediately as described in the “Contact Us” section below. Note that the Hotel cannot guarantee that its servers are completely immune to unauthorized access to stored information. Therefore, the Hotel will not be liable for any breach, intrusion, or damage caused beyond its control.
  6. Data Retention Period

Subject to legal provisions, the Hotel will retain Personal Information for the period necessary to fulfill the purposes outlined below:

  • The purposes for which the Personal Information was provided;
  • The Hotel’s business interests, including data retention;
  • The need to retain information that may be relevant to regulatory investigations or legal proceedings;
  • Compliance with legal requirements, regulations, legal proceedings, including court orders and/or disclosure required by governmental authorities;
  • Fulfilling the Hotel’s legitimate interests and those of third parties, including defense against legal proceedings.
  1. Sensitive Information

Unless specifically requested, the Hotel requests that you do not provide or disclose sensitive Personal Information (for example, social security numbers, data related to race or ethnic origin, political opinions, religion, ideology or other beliefs, health, biometric or genetic data, criminal record, administrative or criminal proceedings, and related sanctions) through the use of the Services or in any other way.

  1. Use of Services by Minors

The Hotel does not knowingly collect Personal Information from individuals under the age of 18.

The Hotel collects Personal Information from individuals under 18 as part of the guest registration process, but always subject to obtaining the consent of the parent or legal guardian. If you are a parent or legal guardian of a minor under 18 and believe your child is using the Website, please notify us immediately. In such cases, we may request Personal Information from you to verify your identity.

  1. Updates

The Hotel may modify and update this Privacy Policy from time to time at its sole discretion without prior notice. The responsibility for being aware of any changes to the Privacy Policy rests solely with the Users.

    • Like many other websites, to enhance the user experience on the Website and its web pages, the Hotel uses “cookies.” Cookies themselves do not provide the Hotel with identifiable Personal Information unless the user chooses to provide such information (for example, by registering for one of the Services).
